Work Visas and Immigration in South Africa
Visas for foreign nationals
There are several different types of visas available for those wishing to do business or work in South Africa.
- Critical Skills Work Visa: For those with skills critical for South Africa’s economy, this visa is good for up to five years.
- General Work Visa: If a worker doesn’t qualify for a critical skills visa, a general work visa may be issued for foreigners who have skills that cannot be found within the country. It is also good for up to five years.
- Intra-company Transfer Work Visa: This four-year visa is a for international companies that are transferring an employee from outside of South Africa to a South African location.
- Corporate Visa: Good for up to four years, corporate visas can help companies that are hiring numerous foreign workers streamline the process.
Foreigners may also apply for a Short-Term Business Visa, which is issued for attending meetings, conferences, or exploring business opportunities in South Africa. It does not permit full-time employment in a South African company.
Sponsorship and employer responsibilities
Hiring a foreign national in South Africa requires compliance with immigration, labor, and tax regulations. The sponsoring employer (or employer of record) must meet the following requirements:
Eligibility criteria
- Confirm that the foreign applicant possesses the required qualifications and that no suitable South African citizen or permanent resident is available.
- Conduct a labor market test, if applicable, through the Department of Employment and Labour.
- Submit a signed job offer, company registration documents, and the applicant’s credentials.
Required documentation
- Valid passport with at least 30 days’ validity beyond the intended stay
- Employment contract specifying job duties, salary, and duration
- Company registration and letter of intent
- Certified copies of educational and professional qualifications
- Work visa application (General Work Visa, Critical Skills Visa, or Intra-company Transfer Visa, depending on the employment type) Completed visa application form and biometric photos
Post-arrival requirements
- Residence Permit: After entering South Africa, the foreign worker must apply for a temporary residence permit if staying longer than 90 days.
- Tax Registration: Register with the South African Revenue Service (SARS) for tax purposes.
- Update local authorities in case of change of address, employment status, or permit renewal.
