Visas for foreign nationals
In Malaysia, hiring foreigners without valid work permits can result in fines up to 100,000 MYR per employee, imprisonment for up to five years, or both. The Malaysian government enforces strict regulations to ensure employment opportunities are first available to Malaysian citizens unless specialized skills are required. Therefore, Malaysia has structured skilled migration programs for foreigners, with provisions for highly skilled professionals in sectors like engineering, healthcare, information technology, and finance. Several types of visas are available for foreign workers in Malaysia.
- Employment Pass (EP): For individuals with a job offer in a managerial, technical, or professional position with a minimum monthly salary of 3,000 MYR.
- Temporary Employment Pass (PVP): For semi-skilled workers in approved sectors such as manufacturing, construction, and agriculture.
- Professional Visit Pass (TEP): For foreign nationals providing services or undergoing training for a short duration.
Foreigners may also apply for a Short-Term Social Visit Pass, which is issued for attending meetings, conferences, or exploring business opportunities in Malaysia. It does not permit full-time employment in a Malaysian company.
Sponsorship and employer responsibilities
Hiring a foreign national in Malaysia requires compliance with immigration, labor, and tax regulations. The sponsoring employer (or employer of record) must meet the following requirements:
Eligibility criteria
- Confirm that the foreign applicant has the required qualifications and that no suitable Malaysian citizen is available.
- Obtain approval for foreign worker quota from the Expatriate Committee.
- Submit a signed job offer, company registration documents, and the applicant’s credentials to the Immigration Department of Malaysia.
Required documentation
- Valid passport with at least 12 months’ validity
- Employment contract specifying job duties, salary, and duration
- Company registration and letter of intent
- Certified copies of educational and professional qualifications
- Work visa application (e.g., Employment Pass, Temporary Employment Pass, or Professional Visit Pass, depending on the employment type)
- Completed visa application form and biometric photos
Post-arrival requirements
- Income tax number: After entering Malaysia, the foreign worker must register with the Inland Revenue Board for tax purposes.
- Social Security Organization (SOCSO): Ensure enrollment for social security coverage.
- Updates: Update local authorities in case of change of address, employment status, or permit renewal.
