Visas for foreign nationals
In Gambia, hiring foreigners without valid work permits can result in fines, legal action, or visa cancellation. Strict monitoring is undertaken by the government to ensure jobs are first available to Gambian citizens unless specialized skills are required. Therefore, the country has limited skilled migration programs for foreigners, but there are provisions for highly skilled professionals in sectors like healthcare, education, and engineering. There are two types of visas for foreign workers in Gambia.
- Expatriate Work Visa: For skilled foreign workers who will be employed in managerial, technical, or professional roles in Gambia.
- Temporary Work Visa: For employees who are coming to Gambia for short-term employment or project-based roles.
Foreigners may also apply for a short-term business visa, which is issued for short-term business visits, attending meetings, or exploring business opportunities in Gambia. It does not permit full-time employment in a Gambian company.
Sponsorship and employer responsibilities
Hiring a foreign national on an employment visa in Gambia requires adherence to specific eligibility criteria, submission of necessary documentation, and payment of applicable fees. The sponsoring employer (or EOR) must meet the following requirements:
Eligibility criteria
- Specialized skills: The foreign national should possess specialized skills or qualifications not readily available in Gambia.
- Labor market test: Employers must demonstrate that no local candidate is suitable for the position.
Required documentation
- Valid passport: An applicant’s passport valid for at least six months beyond the intended period of stay
- Employment contract: A detailed contract specifying the terms of employment, including job role, salary, and duration
- Company registration: Proof of the company’s registration in Gambia
- Educational qualifications: Copies of degrees or certificates relevant to the job position
- Resume/CV: A comprehensive resume detailing the applicant’s professional experience
- Visa application form: Completed and signed visa application form
- Photographs: Recent passport-sized photographs meeting the specifications set by the Gambian consulate or embassy
Post-arrival requirements
- Registration: Foreign nationals holding an employment visa must register with the local immigration authorities within 15 days of arrival in Gambia.
- Tax obligations: Ensure compliance with Gambian tax laws, including obtaining a tax identification number and fulfilling any tax liabilities.
