Visas for foreign nationals
In Brazil, hiring foreigners without valid work permits can result in fines, legal action, or visa cancellation. Strict monitoring is undertaken by the Brazilian government to ensure jobs are first available to Brazilian citizens unless specialized skills are required. Therefore, Brazil has limited skilled migration programs for foreigners, but there are provisions for highly skilled professionals in sectors like IT, engineering, finance, and healthcare.
- VITEM V Visa: Issued to foreign nationals with a job offer from a Brazilian employer for temporary employment, typically valid for up to two years and renewable.
- Permanent Work Visa: Granted to highly skilled professionals, investors, or researchers intending to reside and work in Brazil indefinitely.
Foreigners may also apply for a short-term Business Visa (VITEM II), which is issued for short-term business visits, attending meetings, or exploring business opportunities in Brazil. It does not permit full-time employment in a Brazilian company.
Sponsorship and employer responsibilities
Hiring a foreign national in Brazil requires compliance with immigration, labor, and tax regulations. The sponsoring employer must meet the following requirements:
Eligibility criteria
- Confirm that the foreign applicant has the required qualifications and that no suitable Brazilian citizen is available.
- Obtain approval from the Ministry of Labor and Employment for a work permit.
- Submit a signed employment contract and the applicant’s credentials to the relevant authorities.
Required documentation
- Valid passport with at least six months’ validity
- Employment contract specifying job duties, salary, and duration
- Company registration and letter of intent
- Certified copies of educational and professional qualifications
- Medical certificate confirming the absence of contagious diseases
- Criminal record from the country of origin
- Completed visa application form and biometric photos
Post-arrival requirements
- Taxpayer identification number (CPF): After entering Brazil, the foreign worker must apply for a CPF for tax purposes.
- Social security registration: Register with the National Institute of Social Security (INSS).
- Health insurance: Ensure enrollment in a health insurance plan, or provide private health insurance until eligibility is met.
- Update local authorities in case of change of address, employment status, or permit renewal.
