Visas for foreign nationals
In Argentina, hiring foreigners without valid work permits can result in fines, legal action, or visa cancellation. Strict monitoring is undertaken by the Argentine government to ensure jobs are first available to Argentine citizens unless specialized skills are required. Therefore, Argentina has limited skilled migration programs for foreigners, but there are provisions for highly skilled professionals in sectors like IT, finance, engineering, and healthcare. Several types of visas are available for foreign workers who want to work in Argentina
- Technical/short-term visa: These visas are for foreigners who are performing specific technical or professional tasks for fewer than 90 days.
- Temporary work visas: For foreigners working more than 90 days, these visas are classified as 23A (for contracted personnel) and 23E (for intra-company transfers).
- MERCOSUR visas: If the worker’s home country is part of Mercado Común del Sur (MERCOSUR), they can obtain a MERCOSUR visa through a simplified process that allows working in Argentina for two years. At that time, the worker is usually able to convert to permanent resident status.
- Digital nomad visa: Valid for 180 days and renewable once, this visa allows for remote work with an organization outside of Argentina.
- Investor visa: This visa is for foreigners who have invested a minimum amount into an Argentinian business.
Foreigners may also apply for a short-term business visa, which is issued for short-term business visits, attending meetings, or exploring business opportunities in Argentina. It does not permit full-time employment in an Argentine company.
Sponsorship and employer responsibilities
Hiring a foreign national in Argentina requires compliance with immigration, labor, and tax regulations. The sponsoring employer (or EOR) must meet the requirements below.
Eligibility criteria
- Confirm that the foreign applicant has the required qualifications and that no suitable Argentine citizen is available.
- Obtain approval from the Argentine National Directorate of Migration by demonstrating the necessity of hiring a foreign national.
- Submit a signed employment contract, company registration documents, and the applicant’s credentials to the Argentine consulate or embassy.
Documentation
- Valid passport with at least six months’ validity
- Employment contract specifying job duties, salary, and duration
- Company registration and letter of intent
- Certified copies of educational and professional qualifications
- Work permit application and temporary residence visa application
- Completed visa application form and biometric photos
- Proof of valid medical insurance that covers emergencies, hospitalization, and repatriation
Post-arrival requirements
- After entering Argentina, the foreign worker must apply for a tax identification number (CUIL) for tax purposes.
- Foreign workers must update local authorities in case of change of address, employment status, or permit renewal.
